It’s not a good idea to flee from the police during a DWI stop

Being pulled over by police in Minnesota can be a stress-inducing experience, even for the most law-abiding motorist. However, some individuals may panic during the stop and consider fleeing from law enforcement to avoid arrest.

This impulse, though understandable in the heat of the moment, is dangerous and could make an already serious situation far worse. Motorists might want to explore the ramifications of fleeing a stop for suspected DWI and why cooperation is a better course of action.

Legal consequences of fleeing

Motorists should be aware that attempting to flee from law enforcement only adds to the charges they might be facing. Minnesota law explicitly criminalizes fleeing a police officer, whether by vehicle or on foot. A conviction for attempting to evade the police is a felony and could result in:

  • Up to three years in prison
  • Fines up to $5,000
  • Revocation of driving privileges

Even if the initial DWI stop might have resulted in a misdemeanor charge, fleeing elevates the offense to a felony. Moreover, a successful escape is unlikely since police officers are trained to pursue fleeing suspects. They have patrol vehicles, communication systems and even helicopters if needed.

Furthermore, if someone is killed or seriously injured during a pursuit involving a fleeing suspect, additional charges, such as vehicular homicide or manslaughter may be filed. Even if no injuries occur, reckless driving and endangerment charges may accompany the DWI and fleeing violations. Simply put, an impulsive attempt to escape amplifies risks on every front.

While a DWI arrest is challenging, fleeing from law enforcement officials is the wrong way to address the stress-inducing situation. Motorists are better off cooperating with the police and get experienced legal guidance to protect their rights.
